Terms of Service
1. Acceptance of Terms
By downloading, installing, or using the Flytt app ("App") operated by Nordser AS ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
2. Service Description
Flytt is a mobile application that facilitates the movement of items from one location to another within Oslo, Norway. Users can schedule pickups and deliveries through the App, which connects them with independent third-party drivers.
3. User Accounts
- To use the Flytt App, you must create an account by providing your first name, last name, phone number, and other required information.
- You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
- You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Booking Process
- Users must select a pickup address, delivery address, desired arrival date and time, and complete the booking process as prompted in the App.
- Payment for the service will be scheduled after the booking is confirmed.
- Users are encouraged to accept push notifications to receive important updates about their service.
5. Service Execution
- On the day of service, users will be notified approximately 5 minutes before the driver's arrival.
- Drivers have a one-hour window to arrive at the pickup location based on the user's chosen arrival time.
- Waiting time policies:
- At pickup: The driver will wait for a maximum of 5 minutes after arrival.
- At delivery: The driver will wait for a maximum of 5 minutes after arrival.
- If the recipient is not available at the delivery address within the specified waiting time, the driver may leave the item at a safe location or return it to our facility, with additional fees applied.
6. Company Responsibility
- The Company is responsible for the wellbeing of the item during transit only.
- The Company's responsibility begins when the driver takes possession of the item and ends when the item is delivered or the maximum waiting time at the delivery location has elapsed.
- The Company is not responsible for any damage or loss that occurs before pickup or after delivery.
7. Cancellation Policy
- Same Day Bookings:
- Free cancellation up to 2 hours before the booked time.
- 50% of the scheduled hourly price if canceled between 2 hours and the scheduled start time.
- 75% of the scheduled hourly price if canceled after the service provider has started driving to the location.
- Scheduled Bookings:
- Free cancellation up to 2 days before the scheduled time.
- 50% of the scheduled hourly price if canceled between 2 days and the scheduled start time.
- 75% of the scheduled hourly price if canceled after the service provider has started driving to the location.
- Exceptions: No fee for cancellations due to verifiable emergencies or unavoidable circumstances (e.g., severe weather, accidents). Verification required via support email.
8. Independent Contractors
- Drivers providing services through the Flytt App are independent contractors and are not employees of Nordser AS.
- Nordser AS does not guarantee the suitability, safety, or ability of third-party providers. You agree that the entire risk arising out of your use of the services remains solely with you, to the maximum extent permitted under applicable law.
9. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any local, state, national, or international law.
- Interfere with or disrupt the operation of the App or the servers or networks used to make the App available.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Nordser AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the App.
- Any conduct or content of any third party on the App.
- Any content obtained from the App.
- Unauthorized access, use, or alteration of your transmissions or content.
11. Modifications to the Service and Terms
Nordser AS reserves the right to modify or discontinue, temporarily or permanently, the App or any features or portions thereof without prior notice. We may also update these Terms from time to time. Your continued use of the App following the posting of any changes to the Terms constitutes acceptance of those changes.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Norway. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Oslo, Norway.
